1. Acceptance of Terms
By downloading, installing, or using the Numbies mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Numbies is a tree planting operations management application designed to help tree planting crews track daily planting activities, manage crew members, record block and seedlot information, transfer day setup and planter entry data between devices, and generate reports. The App operates locally on your device with no Numbies cloud storage or external Numbies servers.
3. User Responsibilities
You are responsible for:
- Maintaining the accuracy of data you enter into the App
- Regularly backing up your data using the App's built-in backup functionality
- Keeping your device secure and protected from unauthorized access
- Ensuring you have appropriate permissions to use the App in your jurisdiction
- Using the App in compliance with all applicable laws and regulations
- Sharing QR codes, export files, backup files, and reports only with people you trust
4. Data Ownership and Storage
You own all data you create and store in the App. All data is stored locally on your device using React Native AsyncStorage. We do not collect, transmit to our servers, or store any of your data on external servers. You are solely responsible for backing up your data and maintaining copies of important information.
5. Device Permissions, QR Codes, and Sharing
The App may request camera access so you can scan QR codes generated by Numbies on another device. Camera access is used only for QR code scanning. The App does not take photos, record videos, store camera images, or send camera data to Numbies or third-party analytics services.
QR codes, export files, backup files, and reports may contain crew, block, seedlot, planting, earnings, and report data that you entered into the App. When you display, scan, export, import, or share that information, you are responsible for making sure it is shared only with appropriate people and through appropriate methods.
6. Intellectual Property
The Numbies App, including its design, code, graphics, and other materials, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without express written permission.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the App will be error-free, secure, or uninterrupted.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the App
- Any unauthorized access to or use of your device
- Any bugs, viruses, or other harmful code that may be transmitted to or through the App
- Any errors or omissions in any content or data loss of any kind incurred
- Your failure to back up your data
- Your sharing of QR codes, export files, backup files, reports, or other App data with another person or service
9. No Warranty of Accuracy
While we strive to provide accurate calculations and functionality, we make no guarantees about the accuracy of tree counts, earnings calculations, statistics, or any other computations performed by the App. You should verify all important calculations independently.
10. Updates and Modifications
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will update the "Last Updated" date at the top of this document when changes are made.
11. No Professional Advice
The App is a tool for tracking and organizing tree planting data. It does not provide professional, legal, financial, or operational advice. Any decisions you make based on data from the App are your own responsibility.
12. Termination
You may stop using the App at any time by uninstalling it from your device. Please note that uninstalling the App will delete all locally stored data unless you have created a backup using the App's backup functionality.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to its conflict of law provisions.

15. Severability

These Terms constitute the entire agreement between you and Numbies regarding the use of the App and supersede any prior agreements or understandings.
